Omegon Teachware, Stuttgarter 12, 71229 Leonberg, hereinafter Omegon
1. General information
All services are accepted solely on the basis of the following general terms and conditions.
Derogations are only valid if agreed in writing between the customer and Omegon.
The conditions for software licenses are listed in a separate license agreement.
2. Offer and conclusion of contract
Our offers are subject to confirmation and non-binding.
The validity of the offers is specified as in the respective offer.
After this lifetime expires Omegon is no longer bound to the prices stated in the offer and delivery dates.
Omegon reserves the right to make a change while maintaining the essential characteristics of the product at any time and without a display.
By the order of the desired product, the customer submits a binding offer to conclude of a purchase contract.
Omegon is entitled to accept this offer by sending an order confirmation.
3. Prices and shipping costs
The prices stated in our order confirmation shall apply.
All prices include the legal VAT and plus shipping, unless determined otherwise by Omegon.
Omegon charged a shipping charge of 5,00 EUR plus VAT for orders less than 250 euros. For orders over 250 euro Omegon takes over the shipping to the destination in the country, provided, the carrier is determined by Omegon.
The prices are also for international deliveries EXW in euro. For deliveries abroad, the buyer assumes the additional taxes and duties, unless otherwise expressly set Omegon.
Shipments abroad are calculated according to effective cost. The shipping costs if you ask via email.
Without specific instructions, we send in the way that seems best suited to us.
The delivery time is communicated to the customer with the order confirmation.
Partial deliveries are permitted. Each part delivery is considered self-employed delivery and performance, unless determined otherwise by Omegon.
5. Terms of payment
Delivery within Germany, following methods of payment are possible:
The customer is obliged to pay the purchase price immediately transfers to the account of Omegon after conclusion of the contract.
This payment method is mandatory for the delivery at a license activation.
For payment in advance, you will receive an email with the exact billing information. Please enter so be sure your email address and/or your phone number into the order form, so that a contact is possible. Please indicate your name and invoice number with your bank transfer as the purpose that can be associated with your receipt of payment of the order.
Invoices are due within 14 days after the invoice date without deduction to the payment. It only accepted listed and set terms of payment by Omegon.
Until full payment the goods remain the property of Omegon
(Retention of title according to §§ 158, 449 BGB). Exceeding the agreed payment deadlines, reminders and handling charges must be calculated.
In arrears despite reminders and deadline Omegon may above the base rate for the calculation of interest on arrears in the amount of 5%.
6. Right of return
A special general right of return of the goods is admitted for 14 days from delivery if the goods are in their original packaging and undamaged.
When ordering up to 40,-EUR the customer shall bear the costs of returning the goods. Omegon agrees with the return or exchange of goods, the customer is obliged to provide the goods within 72 hours weekdays to the pickup by Omegon. The customer is not entitled to the unauthorized return.
It is not possible to return a delivered software license. A full assessment, which is crucial for a purchase decision is given by a trial or time-limited full version provided on request.
As far as a guarantee-requiring defect is present, this must be communicated within one week after receipt of Omegon. The customer is entitled to demand subsequent performance, to withdraw from the contract or reduce the purchase price in the legal framework. Further claims, in particular claims for damages are excluded. The limitation period of warranty claims for delivered goods is 1 month from receipt of the goods.
For other than damage caused by injury of life, body and health Omegon only liable insofar as they are based on intentional or grossly negligent action or culpable breach of an essential contractual obligation by Omegon. Omegon same extent shall be liable for the negligence of couriers. A further liability for damages is excluded.
The provisions of the product liability Act shall remain unaffected.
According to the current state of the art, an error-free data communication over the Internet cannot be guaranteed. Accordingly, Omegon can technically ensure no permanent or uninterrupted availability of the online trade. Omegon is therefore not liable for the delayed processing or acceptance of offers.
9. Data protection
Omegon used the data transmitted by the customer exclusively for the handling of orders. All customer data will be kept strictly confidential by Omegon. A transfer of data to third parties (e.g. shipping services) done by Omegon only, unless this is necessary for order processing. The order data is encrypted and transmitted securely.
Omegon assumes no liability for data security during these transmissions over the Internet (e.g. due to technical fault of the provider) or for a possible criminal access third party files the Internet presence.
All represented third-party logos, images, and graphics are the property of the respective companies and are subject to the copyright of the respective licensor. All photos shown on these pages, logos, texts, reports, scripts and programming routines which are developments of Omegon or were prepared by Omegon, may not be copied without consent or used for other purposes. All rights reserved.
11. Links on our pages
Omegon expressly distances itself from all contents of all linked sites on the homepage of Omegon. This declaration applies to all links on the Website.
For these terms and conditions, as well as the relationships between Omegon and buyers, the right of the Federal Republic of Germany applies. Other national laws, as well as the international sale of goods is excluded.
Claims must be acknowledged in writing by Omegon.
Exclusive place of jurisdiction is the headquarters of Omegon.
